Terms of Use — Elevator Matrix
DRAFT for review by a lawyer. Version 0.1 — September 2026.
1. Subject Matter
Elevator Matrix (hereinafter "the Service") is software as a service (SaaS) for the management of lift maintenance and installation companies: a register of lifts and customers, a maintenance schedule in accordance with the applicable legislation (ΚΥΑ Φ.Α/9.2/ΟΙΚ.28425/2008 (Greek Joint Ministerial Decision on lifts), as in force), work orders, faults, stock, accounting documents, payment collections and ancillary artificial intelligence features. The provider of the Service is the business shown in the contact details on the website elevatormatrix.com (hereinafter "the Provider"), with its registered office in Thessaloniki.
These Terms govern the relationship between the Provider and each business customer (hereinafter "the Customer") that creates a company account. The Service is intended exclusively for professionals and businesses (B2B) and not for consumers.
2. Accounts and Users
- The company account is created by a natural person who declares that they have the authority to bind the Customer (the "Owner"). The Owner may invite users (office staff, responsible maintenance engineers, technicians, accountant) within the limits of their plan.
- The Customer is responsible for the accuracy of the registration details (company name, Tax Identification Number (ΑΦΜ), email), for safeguarding passwords and for every action performed through the accounts of its users.
- The Customer must notify the Provider immediately of any unauthorised use.
- It is prohibited to use the Service for unlawful purposes, to infringe the rights of third parties, to attempt to circumvent the security mechanisms and to resell the Service without a written agreement.
3. Customer Data — Roles under the GDPR
- The data entered by the Customer (customers, building managers, contacts, lifts, work orders, accounting documents) belong to the Customer. The Customer is the Controller and the Provider is the Processor within the meaning of Regulation (EU) 2016/679 (GDPR) and Law 4624/2019 (ν. 4624/2019, Greek data protection law).
- The terms of processing are set out in the Data Processing Agreement (DPA), which forms an integral part of these Terms.
- The Provider processes the data solely for the provision of the Service, in accordance with the Customer's documented instructions, and does not use them for its own purposes or transfer them to third parties other than the sub-processors listed in the DPA.
- The Customer warrants that it has a lawful basis for entering the personal data of third parties (e.g. building managers, occupants reporting faults) into the Service.
4. Artificial Intelligence Features
The ancillary AI features (structuring of voice descriptions, identification of components from photographs, diagnosis based on manuals) generate suggestions that must be checked by a licensed technician. They do not replace professional judgement, the inspections required by law or the manufacturer's instructions. The Provider shall not be liable for decisions taken solely on the basis of such suggestions.
5. Availability and Support
- The Provider uses reasonable endeavours to achieve availability of the Service of 99% per month, excluding scheduled maintenance (with at least 24 hours' notice where practicable) and events of force majeure.
- The application also operates offline and synchronises data once the connection is restored. The Customer must keep the application updated to current versions.
- Daily backups are taken. The Customer may at any time export all of its data in JSON format from the Settings.
- Support is provided by email on business days during business hours.
6. Pricing and Free Period
- Until 1 January 2027 the Service is provided free of charge to all Customers, without requiring a card. The usage limits (users, lifts) of the free plan are shown in the "Subscription" section.
- From 2027 a subscription price list will apply (Starter / Pro / Enterprise). The Provider will notify Customers at least 60 days before charging begins. Non-acceptance of the price list entitles the Customer to terminate the contract and to export its data free of charge.
- Prices are in euros, exclusive of VAT, and are invoiced monthly or annually in advance. Late payment of more than 30 days may lead to suspension of the account following written notice.
7. Suspension and Termination
- The Provider may temporarily suspend an account in the event of breach of the Terms, non-payment or a risk to the security of the Service, informing the Customer accordingly. During suspension the data are retained and the Customer may request their export.
- The Customer may terminate the contract at any time by submitting an account deletion request from the Settings or by email. The data are permanently deleted within 30 days of confirmation of the request, except for those that must be retained by law (e.g. tax records).
- The Provider may terminate the contract on 60 days' notice, providing the opportunity to export data.
8. Intellectual Property
The software, the compliance rules base, the artwork and the trade mark "Elevator Matrix" belong to the Provider. The Customer receives a non-exclusive, non-transferable licence of use for the term of the contract. The Customer's data and documents remain its property.
9. Limitation of Liability
- The Service is an organisational tool. Compliance with the obligations of maintenance, inspection and registration in the Lift Register remains the sole responsibility of the Customer as a licensed maintenance contractor.
- To the maximum extent permitted by law, the Provider shall not be liable for indirect or consequential loss (loss of profits, loss of data due to a non-updated application, fines due to omissions of the Customer). The Provider's aggregate liability is limited to the amount paid by the Customer in the preceding 12 months (for the free period: €0), save in cases of wilful misconduct or gross negligence.
10. Amendments
The Provider may amend the Terms by notice within the application or by email at least 30 days before they take effect. Continued use constitutes acceptance. Material changes to the detriment of the Customer entitle it to terminate without cost.
11. Governing Law and Jurisdiction
These Terms are governed by Greek law. The courts of Thessaloniki shall have jurisdiction over any dispute. Before recourse to the courts, the parties shall seek an amicable settlement.
